Question
Complete details of all council houses sold by Charnwood Borough Council and associated departments under the "Right to Buy" scheme, since 1st January 2002, to date. Details should include full property address - including house number or name, first line of address, and postcode.

We have, as required by the Freedom of Information Act (the Act), undertaken an assessment to ascertain if any of the exemptions provided by the Act apply to the information that you have requested. Having completed this assessment we have concluded that part of the information you requested, namely the full address and postcode is exempt from disclosure under Section 40(2) of the Act and we will not, therefore, be able to supply it.
Section 40(2) of the Act covers personal data where the person requesting the information is not the data subject and disclosure of the information would breach one or more of the data protection principles in the Act. Personal data is defined in the Data Protection Act 1998 as data which relate to a living individual who can be identified-
(a) from those data, or
(b) from those data and other information which is in the possession of, or is likely to come into the possession of, the data controller.
Part of the information you requested would identify individual properties. It is our view that the disclosure of a list of complete addresses for these properties could be used to identify significant biographical information about the individuals concerned (the data subjects). In the absence of consent from the data subjects, in order for the Council to comply with the first Data Protection principle (processing of personal information must be far and lawful), it must consider whether providing the information is necessary for the legitimate interests of the Council or the person to whom the information is disclosed. This must be balanced with the rights and legitimate interests of the data
subjects. The Council has concluded that providing the information enclosed but not providing the full address and postcode provides the appropriate balance in this case.
