COUNCIL WARNS FLY-TIPPERS AFTER SECOND PROSECUTION

FLY-TIPPERS are being warned they will not get away with illegally dumping rubbish in Charnwood after the Borough Council successfully gained its second prosecution in a week.

Dean Stewart, of Churchgate, Old School Lane, Bagworth, pleaded guilty to two counts of contravening section 33 of the Environment Protection Act 1990 when he appeared at Leicester City Magistrates Court.

The 34-year-old had been employed as a builder to demolish outbuildings and build an extension at a property in Hollow Road, Anstey.

All the materials were taken away in skips except for four roofing sheets of bonded asbestos which Stewart dumped over the rear fence of the property on to waste ground.

The occupants who had employed Stewart discovered the asbestos sheets a fortnight later and contacted Charnwood Borough Council.

Stewart, who has no previous convictions for fly-tipping, admitted two charges of depositing controlled waste and was fined £200 and ordered to pay £500 in costs.

It was the second successful prosecution for the Authority in the space of a week as Steven John Bott, of Egerton Road, Leicester, pleaded guilty to two counts of contravening Section 33 of the Environmental Protection Act 1990 when he appeared before Leicester City Magistrates Court.

That case was adjourned so pre-sentence reports could be prepared and Bott was bailed to return to Leicester Magistrates Court on Monday, 3rd September.

Chris Cary, Charnwood Borough Council’s Senior Environmental Crime Enforcement Officer, said: “This is another clear indication that fly-tipping in Charnwood will not be tolerated.

“We will track down those perpetrators who illegally dump rubbish in the area and bring them to justice for blighting our Borough with their actions.”

Cllr Mike Preston, Charnwood Borough Council’s Cabinet member for the Environment, added: “This is a great result and sends out yet another warning to fly-tippers that they could end up with a criminal record for failing to dispose of waste correctly.

“We will continue to take legal action against fly-tipping offenders who have a complete disregard for everyone else in Charnwood.”
