We act on behalf of Centrepoints International Associates, who collect used clothing and shoes from recycling banks within the administrative area of Charnwood Borough Council.
We have been advised to commence litigation concerning the interference of goods under Torts (Interference with Goods) Act 1977 against Charnwood Borough Council for the actions of its waste department and in particular its officer Neil Greenhalgh.
Prior to instructing our legal representative to issue the relevant documents we require additional information.
Under the Freedom of Information Act 2000 we hereby request that you supply the following information:
1. A list of all recycling sites in your district.
2. Please state the name of each landowner of each site.
3. Please supply a copy of the agreement between the Council and the landowner in which it states the provisions which empower the Council to exercise eviction action against any 3rd party operators who carry out activities on the same land.
4. Please state the date when each agreement commenced.

Information in respect of property ownership is already accessible through the Land Registry (http://www.landregistry.gov.uk/);
Attached is a copy of a general agreement that the Council has with landowners and leaseholders at community recycling sites. In addition the Council may take action in response to requests from landowners and leaseholders which could occur at any time.
