I am writing to request information under the Freedom of Information Act 2000.
All information and files held relating to Your reference MJN/680.17 dated 23 January 2002 and MJN/680.11 dated 7th March 2003 and all other information held in relation to this correspondence.
Due to a legal claim against the previous occupants of 19 Main Street, Newtown Linford, we require any and all information held by Charnwood Borough Council regarding my request.
Our Engineering team have check their records and have confirmed that all paper records going back to 2002/03 were destroyed in 2009 during office re-organisations.
There are only 2 documents held electronically from the same period quoting similar references to the ones in your request, but neither document relates to 19 Main Street, Newtown Linford nor were they dated in January 2002 or March 2003.
Charnwood Borough Council have responsibility as the Land Drainage authority to ensure all the ordinary watercourses within the borough are free flowing and free from unnecessary flood risk. The authority has the necessary powers to enforce owners of land adjacent to an ordinary watercourse (Riparian Owners) to maintain their watercourse.
It seems that back in 2002/3 there was an issue with the maintenance of a watercourse, unfortunately we do not hold any further records relating to this.
We are therefore unable to provide any further information in answer to your request.
