Public liability claims

If you have suffered personal injury or if your property has been damaged and you wish to make a claim for compensation this can only be progressed if we receive a completed Incident Report Form. 

We do not take details over the phone in case we misinterpret any of the information given to us.

Insurance incident report form

An acknowledgement will be sent to you on receipt of this form. If you do not hear from us within 10 working days of returning this form please contact us.

Your claim will be passed to our Public Liability Insurers and the Insurance Officer will request a full report from the relevant service area. That service area will complete an investigation and relevant documentation will then be passed to our insurers via the Insurance Officer.

Once our insurers have received your claim, they will acknowledge receipt and carry out their own investigations. The insurers will correspond directly with you.

For claims involving injury and where the sum claimed is up to £25,000 the process should take no more than 40 days for a decision to be made on whether compensation is to be offered or not.  For injury claims above £25,000 the process may take longer.  

For claims not involving any injuries, the process should be shorter than 90 days however it should be noted that all claims are assessed on a case-by-case basis and timescales may vary.

If the Council is found to be legally liabile for your loss, the Council's liability is limited to the value of the loss immediately prior to your incident. Any payments made will not be on a 'new for old' basis as would be the case if you claimed through your own insurers.
